TeliaSon Era and Google (Competition Law) Dissertation

TeliaSon Era and Google (Competition Law) - Dissertation Example However, it can be agreed that attaining this desirable status, in which all stakeholders benefit optimally, is relatively challenging. Coupled with increased pressure from the market to make profits, most business persons have opted for satisfying their needs at the expense of the consumer. Furthermore, individual business entities have gone to great lengths to attain and maintain a competitive edge in the markets that they explore. In essence, they take measures that are geared towards enhancing their performance and outperforming their counterparts. They have adopted malpractices such as collusive price fixing, predatory pricing, tie-up sale, discriminatory pricing and creating barriers to market entry amongst others. These trends have had adverse effects on both the consumers and other business persons in the market. To address these, regulatory policies have been put in place. Perhaps one that has been more effective in addressing the preceding concern is competition policy. Com petition policy constitutes a set of measures adopted by the government which direct the behavior of the businesses as well as the structure of the entire business industry. Their main aim is to maximize the welfare of the affected stakeholders and promote effective and efficient performance. They provide useful insights regarding how business entities and individuals can explore the market and enhance healthy competition. Further, they offer guidelines regarding how to prevent anti competitive practices that hurt the industry and undermine sustainable growth and development. At this point, it cannot be disputed that unfair competitive practices promote aggression that has detrimental effects on the performance of businesses. In... As globalization trends continue to grow complex and intricate, firms are increasingly being compelled to adopt approaches and practices that can enable them to attain and maintain a competitive edge in the market. This has prompted them to in some instances adopt practices that have harmful effects on their competitors as well to the consumer base. Monopolistic firms have particularly been affected the most because of their influence in the market. Coupled with their ability to make critical decisions regarding the products and services that they provide, the inherent power has made them to make decisions that have negative effects on their respective industries. Legal provisions have been established on a national, regional and international scale to guide their behavior in this regard. This ensures that the decisions that they make do not affect the functioning of the market and the general wellbeing of the market. Competition law has particularly been imperative in ensuring that this behavior or that their practices are economically viable. One of the tendencies that have been noted in the market pertains to violation of the competition law through margin squeeze.

Communication & Crisis Essay Example for Free

Communication Crisis Essay Many disasters happen around us that we have no control over, nor do we know what the impact will be of these disasters long term and short term. On the environment surrounding us as well as what it may do to our health. Working as the director of health for my region it is my job to stay on top of such issues. Keeping an eye out for such emergencies that may endanger us in our everyday living space and most of all our health. I want to go through how I might deal with such situations and how I would address it head on. While at the same time keeping the public informed without overwhelming them as well as looking at who I would collaborate with to make this situation resolve in the smoothest and best way possible. The issue that has come to my attention is water contamination in a certain area. This contamination is life threatening and needs to be acknowledged and dealt with accurately and promptly. As I am the director of emergency health situations I see myself and the mediator and problem solver between the public (people) and media. Those two things are there for each other but if you are not too careful they can harm each other; giving out too much information or not enough or sometimes the wrong information can be harmful to all parties involved. Having such a situation on had you need to talk to the right people and receive all the right information. I would first go to the areas that have been affected and gather all the proper data and forms that show what chemicals are incorrect causing this contamination. I need this information for hard copy evidence so when I contact the media or speak in public I will have all the proper information. I will also get the CDC involved if they are not already involved. They will be conducting the proper tests and research to discover what the contaminated bacteria is. They will also have the proper protocol in containing it, as well as seeing the damage it has done to people who have ingested it and come in contact  with it. Finding an antidote will be another task they will have. In such a situation you will also get in contact with the proper news channels; national and local. Having my statements ready giving the media and public the help and information that they need. Communicating in any situation has its advantages and setbacks. Working in such a high pace and high stress industry makes communication that much more important and not to mention difficult. Being in the health care industry means you work and deal with a lot of the same people consistently. This at times can be a good thing. You build relationships with them you become accountable to one another, you even learn each other’s communications styles; you become comfortable with them, in some cases they even become your second family. Having that crutch that comfort in such a high stress and high demand career is needed. As I said befor you become accountable to one another and the team work/bond is unbreakable unparalleled. This kind of bond is desperately needed in such careers. Especially when you are dealing with millions of people’s lives, they always count on me as director of emergency health. Providing them with the best and most accurate information, help and solution to our health care crisis, that is no easy task and I cannot do it on my own. I use me organizations from the inside and outside; to give my best and keep our environment safe and clean. This same relationship is needed in any high profile type of career i.e. chief of medicine of a hospital the president of the United States. They all need to have great communication skills with their organizations and network of people. On the other side of the spectrum you can have communication issues that can do more damage than the crisis itself. You not only need to have basic communication skills with your staff and organizations but as we just finished discussing a great understanding and relationship with each other. If someone in the organizations you deal with miscommunicate on purpose for their own personal gain, whether that be to give themselves an advantage or just to give you a disadvantage, that may hinder your ability to protect yourself and the issue you are trying to solve. Giving you more steps to complete, possibly even making you back track. Making sure you have a good relationship and communication relationship with all the organizations you  deal with inside your office and outside is key. Even if you only deal with them occasionally or if you deal with them on a regular basis. Communicating in a non-crisis situation verses a crisis situation can have its differences. The main importance is no matter the situation your communication should be using the basic knowledge of conversing. Communication in a non-crisis is a little more relaxed, yes you still have things to get across to each other and they are somewhat important; but for the most part your emotions are not running high you have yourself composed and thinking rationally. The stakes aren’t usually as high it’s not a life or heath situation. A crisis situation the emotions are running high, you are frazzled thinking a million miles a minute. Dealing with this type of communication crisis at work should be handled with a calm clear and patient mind frame. We obviously know listening is key in any situation especially a crisis situation. I tend to be the listener when it comes to these situations and just in general. Most likely you will have most of the people in the room (people dealing with the crisis) trying to do the talking and not listening and we know communication is not just talking. I’ve learned from experience that you need to be understanding and patient with everyone in the situation, if you want to get anywhere with solving the issue or just communicating what you mean you need to take a minute and just breathe. Personally I have been in such similar situations before and it really makes a difference if you are the one with a cool head. This way of dealing with things can go for a non-health care setting and a health care setting. I am going to give you a personal story that just so happens to be in a health care setting. About 5 years ago my grandmother was hospitalized she had leukemia and lung cancer as well as a case of pneumonia which is why she went to the hospital. While at the hospital she was infected with MRSA. Once she was diagnosed with MRSA our family went into crisis mode because the doctors told us the prognosis was not good at all. She basically had maybe weeks to live. She was put on life support hoping the MRSA was clearing up and my uncles went into their â€Å"communication mode†. There are 7 brothers including my father and they are all stubborn Armenian men who have the worste communication skills ever. The wives know not to get involved too much because if was their mothers life hanging in the balance;  and none of them have any medical background to really understand what is going on and if they should pull the plug of keep her alive with the machines. As we all know doctors can only tell you so much, my sister and I are the listeners of the family and we are the vice of reason when it comes to most anything. We both just so happen to be the only two with medical backgrounds I am a nurse and she is in her medical resid ency. We had to use our knowledge and better communication skills to inform them and really show them that my grandmother was not coming out of this after we had our what I call â€Å"crisis family meeting† they decided to pull the plug that evening and my grandmother passed. In any situation whether it be medical, personal or work related communication is the same. Something that we are just now getting comfortable using in everyday life as well as crisis situations is modern technology for communicating. This is a useful tool that we still need to learn how to properly use it in such crisis situations. Sending out mass email and text messages to keep the public informed, is one of the best ways we can use social media to alert the public of ever changing crisis management issues. This has just recently eveolved into something we use in this capacity. When hurricane Katrina hit we still only used news and it was a â€Å"wow† new idea to check in with loved one over facebook and twitter because all other forms of communication such as phones were down. How 5-10 years makes a world of differences. Finishing off this paper about communicating during a crisis and how you might communicate during a non-crisis be different. How you should and could deal with people that you need to communicate during a crisis. How it really is important and how much of a new role social media is playing in crisis management. Writing this paper really made me think about how important it is to properly communicate with each other whether it’s for work or social. Being a good communicator is a bog key in all parts of life. Deceitful Clytemnestra of Euripides Electra Essay -- Euripides Electr

Deceitful Clytemnestra of Euripides' Electra Agamemnon returns from Troy, a victorious general, bringing home spoils, riches and fame. He is murdered on the same day as he returns. Clytemnestra, his adulterous wife, has laid in wait for her husband's homecoming and kills him whilst he is being bathed after his long journey. During the Agamemnon, large proportions of the Queen's words are justifications for her action, which is very much concerned with the sacrifice of Iphigenia to the gods, in order for the fleet to set sail for Troy. Aegisthus, the new husband of the Queen Clytemnestra, and partner in the conspiracy to murder the war hero, had reasons, which stemmed from the dispute between the Houses of Atreus and Thyestes. Was the murder justified retribution for a callous and dispassionate murder of an innocent girl, as well as the fate demanded by the family curse? Or was the death of Agamemnon an unjust action by the traitorous woman Clytemnestra and her lover carried out in aspirations of his wealth and power?   If we take the former of the arguments as the correct one, then the sacrifice of Iphigenia must be considered. For this, the only sources we have are those of the Chorus' songs and the highly biased accounts by Clytemnestra, who has been left to stew on her hatred for over ten years. The account given by the Chorus is full of pathos and pity "gentle curving lips...gag her hard...her glance...wounding every murderer" (235-239). They remember with sorrow, a flashback to her innocent life, and recount how she once "sang to Saving Zeus - transfixed with joy" 245. Emphasis is very much on the purity of the girl and how she did not deserve to die. However, no reference is made by the Chorus that it was Agamemnon's... ...ght have been a sponge. It is ironic I suppose that Agamemnon, lord of men was brought down by the one thing that neither of the two sons of Atreus were able to control - Women. Islam and Confucianism

During the post-classical period, the Islamic and Confucianist â€Å"world religions?were based upon the principles of spiritual and intellectual growth. Both valued intelligence and knowledge, and strongly supported education, yet each religion viewed the world and its inhabitants from different vantage points. In Islam, life was a series of tests which determined a person†s stature in the afterlife. Though not especially rigorous, these â€Å"tests?focus people†s lifestyles on ways to better their eternal futures. Islam molded people into charitable, honest, and true Muslims who worked to spread their faith. Confucianism saw the world in a more immediate sense, and felt that it needed to be controlled by properly trained men. Confucianism pushed for social gain, personal happiness, and proper â€Å"gentlemanly?composure. An Islamic education was available to any good Muslim, rich and poor alike, although the wealthy were educated more often, due to fewer time constraints. It was a rarity to see a Muslim woman educated in the same manner as men, however, since Muslim society was strongly patriarchal, and â€Å"Men are the managers of the affairs of women? (p. 105, The Koran and Family). A Confucian education, in contrast, was quite esoteric. Those in the wealthy classes, primarily the aristocracy, were educated, and although it was possible for a lower class citizen to receive an education, it was a rarity, occurring only if said citizen was very wealthy. The Confucian focus on creating a classic â€Å"Gentleman?centered the education on men, and not women. â€Å"Confucianism was primarily an ethical system†¦Confucious largely recommended obedience and respect; people should know their place? (World History, p. 46). Confucianism strove to create an educated man: a ruler, not a peasant. It taught art and literature, nature and proper handling of women, and diplomacy. It stressed composure and proper social skills, with specifics on how to dress and how to act at public gatherings being of the utmost importance. Mannerisms were not the whole of the social education, however. Training the Aristocracy, Confucianism taught ruling, government, law, crime and punishment. A Confucian Gentleman knew how to act properly and rule accordingly in any situation that might present itself. Islam†s Five Pillars, â€Å"testifying that there is no deity save Allah and that Mohammed is his apostle, on performing prayer, on paying legal alms, on the pilgrimage to Mecca, and on the fast of Ramadà ¡n.?(document 18, p. 108) strongly focused the Islamic education on religion and philanthropy. An educated Muslim had intricate knowledge of Islam, the Hadith, and the Koran. Generosity was important in Islam, and a good Muslim gave Alms. Islam did not focus on making an Aristocrat, but rather a philanthropist who would spread the religion. Islam taught the knowledge of travel, trade and bartering as well. Muslim society, was advanced in these areas, and viewed merchants as very powerful and important men. Subsequently trade and bartering were highly valued skills which need to be learned. Scientific knowledge was also important. Muslim science was based on Greek and Hellenistic technology and philosophy, thus their scientific education focused on rationalistic generalizations, theories and hypotheses. Confucian teaching frowned upon trade and bartering, as Merchants were tolerated, but not respected by the upper classes. Confucian scientific teaching was directed towards specific developments and advancements, generalities were not as important. The Confucian lack of religious teaching was diametrically opposed to the Islamic education†s strong religious focus, and Confucianism taught artistic merit more where Islam taught more trade skills. Scientific advances were important to each. Specific social customs were taught by both, although Islam leaned towards helping the lower classes through charity, and Confucianism leaned towards helping the lower classes through proper rule. Obviously, a Confucian education and an Islamic education both focused on teaching men to better themselves, but their different approaches to the same matter yielded two strikingly different educated persons.

I Am Sam (Movie)

‘I Am Sam’- Assessment Sam is the main character in ‘I Am Sam’. He faces a number of issues throughout the movie, but the main hardship is to gain custody of his daughter. Sam’s role is a mentally retarded male, with a mental capacity of a seven year old. Sam’s daughter, Lucy, is seven and her teachers fear that Sam’s aptitude is holding her back because she does not want to be smarter than her father. Lucy loves Sam very much, however she knows he was not the average father, as she told her best friend that she was adopted.Lucy is taken away from Sam by the authorities and is only given visitational rights for a couple of hours each week while under supervision. Sam desperately seeks to gain back custody of Lucy. The approach Sam uses to muddle through this adversity, is trying to find a lawyer who can represent him in court. Rita Harrison Williams is a top-notch lawyer and informs Sam he can’t afford her. As a result, Ritaâ€⠄¢s work colleagues assume she would never do Pro Bono because she is too good for that, however to Sam’s advantage, Rita decides to prove them wrong and takes Sam’s case on Pro Bono. This is great for Sam because he gets a top-quality lawyer to represent him in court for free, this illustrates Sam would have never been able to afford a lawyer in the first place, as Sam is aware of this himself, saying â€Å"Yeah, because I make $8. 00 an hour at Starbucks. Per hour. It’s an hourly rate. † To a large extent, I think this tactic had benefited Sam as he had an excellent lawyer, which gave him a better chance to have some rights to Lucy.Rita knows Sam’s chances are slim for getting full custody of Lucy but in the end, with all characters coming to an agreement, Sam gets joint custody of Lucy with her adoptive parents which was of crucial importance both to the relationship between father and daughter and most importantly Lucy having a well balanced upb ringing and not being held back intellectually, emotionally or financially. Without Rita, Sam would have lost all his visiting rights to Lucy and this would have led to the destruction of Sam mentally even further. This is why I believe Rita had a significant impact, with such a successful outcome. This film has changed my views on parents with a disability and them having normal children. Sam realized he couldn’t raise Lucy by himself and yearned for Lucy to have a mother. Sam to Randy (adoptive mother): â€Å"If I tell you a secret, that I can’t do it by myself†¦ because I always wanted Lucy to have a mother†¦ Help. I need somebody. Help. Not just anyone. I believe that mentally retarded people are capable of giving loads of love to a child, they would cherish them heaps, but I don’t think they can give their child/ren the required thought mentally, intellectually or financially. If people with mental disabilities so desire to raise their child, they should be granted joint custody with another sound adoptive family, as in this particular film, thus I don’t know if a vast amount of adoptive parents in this day and age would be accommodating to this kind of arrangement. This movie also portrays to what extent a parent is willing to sacrifice their environment, security and finances both mentally and physically for their child/ren. This movie couldn’t really help me as a person, as I feel it does not relate to me directly, though the clear message I obtained was, there is ‘always a solution’ for an issue, so long as you ‘consider others involved’ and meet half way and ‘compromise’ so you achieve a ‘positive outcome for all’ parties involved, not just for ones self-seeking way.Sam also taught Rita the meaning of love and whether you could endure love single-handedly, however this was very apparent in the film as having a negative outcome if it was solely based on lov e alone. I would rate the movie ‘I Am Sam’ 7 out of 10 because I liked the ideas, morals and story line of the film, but it had some inauspicious aspects to it. The idea to base the movie on a mentally retarded man is unique and I admire plots that are out of the ordinary. However, the critical aspect of the film was, it’s predictability, most of the scenes/settings had a blue tinge to it (e. g. court room, place where authorities were keeping Lucy and Rita’s house) giving the movie/scene a colder, detached feeling, especially in the scenes where you were suppose to have happy tears, the plot was also a tad slow although it was an emotionally touching film, I’d imagine this film could have offended some viewers.Overall, I enjoyed the film and it brought a tear to my eye, though it did not keep me mesmerized, thus loosing focus now and then. I would recommend ‘I am Sam’ to someone wanting to watch a movie that will touch them emotionally or someone trying to ‘overcome adversity’, so they learn ‘compromise’, but otherwise it’s not really a film I would recommend to anyone for the sake of it.
